Plaintiffs' allegations against motor carriers of “spoliation” of evidence have become routine in truck accident litigation in the US.  Moreover, as several recent US cases have shown, proof of evidence spoliation can lead to significantly adverse consequences for the motor carrier, such as being defaulted on liability and required to pay higher jury verdicts.  Learn the spoliation pitfalls and how to avoid them from this experienced panel.  Andrew Fay, motor carrier defense attorney and trial counsel at LeClair Ryan in Boston, MA, James Hrycay, an accident reconstruction engineer based in Windsor, ON who has handled files all across North America on behalf of motor carriers including giving expert testimony in multiple Provinces and States, and Eric Nau, counsel inside a billion dollar US motor carrier with operations on both sides of the border, will provide insight on the legal, technical and practical perspectives of the problems presented by allegations of spoliation of evidence and what to do about them.
